Privacy Policy

1. Who we are
NestWiseIQ (“NestWiseIQ,” “we,” “us,” or “our”) operates the website nestwiseiq.com and related services (the “Services”). NestWiseIQ is based in Palm Beach County, Florida, United States. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you visit our website, browse community intelligence, view realtor profiles, submit a lead or contact form, join our waitlist or newsletter, sign in with a third-party identity provider, or otherwise interact with us.
If you do not agree with this Policy, please do not use the Services.
2. Information we collect
a. Information you provide
- Account information: name, email address, and (if you sign in with Google) the profile information Google shares with us such as your name, email, and avatar.
- Realtor application information: business name, license number, brokerage, contact information, service areas, bio, photo, and other materials you submit to be listed in our realtor directory.
- Lead and contact form information: name, email, phone (optional), subject, message, and the page from which you submitted the form.
- Waitlist and newsletter information: name, email, user type (buyer, renter, or realtor), and referral information.
- Payment information: if you subscribe to a paid plan, our payment processor (Stripe) collects card details on our behalf. We do not store full card numbers on our servers.
b. Information collected automatically
- Usage data: pages viewed, searches performed, communities and realtor profiles visited, buttons clicked, referring URL, and approximate session timing.
- Device data: IP address, user-agent string, device type, browser, operating system, and language settings.
- Cookies and similar technologies: we use strictly necessary cookies for authentication and session management, and first-party analytics identifiers (such as a session ID stored in your browser) to understand how the Services are used. See Section 6.
c. Information from third parties
- Identity providers: when you sign in with Google OAuth, Google sends us basic profile information you authorized.
- Public sources: we may enrich realtor and community data from public real-estate, municipal, school, and demographic sources.
3. How we use information
- To provide, operate, secure, and improve the Services.
- To create and manage your account and authenticate sign-ins.
- To respond to contact-form messages and other inquiries.
- To deliver community intelligence, realtor directory listings, and search results.
- To process and route leads to the appropriate realtor or partner.
- To send transactional emails (account confirmations, lead receipts, password resets, billing notices).
- To send waitlist or newsletter updates you have opted into; you can unsubscribe at any time.
- To measure feature usage, debug issues, and improve performance through first-party analytics.
- To prevent fraud, abuse, and violations of our Terms.
- To comply with applicable legal obligations, including Florida and U.S. federal law.
4. Legal bases
Where required by law, we rely on the following legal bases: performance of a contract (providing the Services you request), our legitimate interests (operating, securing, and improving the Services), your consent (for marketing emails and optional cookies), and compliance with legal obligations.
5. Sharing of information
We share personal information only as described below:
- Service providers (processors): hosting, database, email delivery, error monitoring, analytics, and payment processing vendors who act on our instructions, including Supabase, Cloudflare, Stripe, and our email infrastructure provider.
- Realtors you contact: when you submit a lead form connected to a realtor profile, we share the lead with that realtor so they can respond.
- Legal and safety: when required by law, subpoena, court order, or to protect rights, property, or safety.
- Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.
We do not sell personal information for money, and we do not share personal information for cross-context behavioral advertising.
6. Cookies and analytics
We use a small set of cookies and similar technologies: strictly necessary (for sign-in sessions and CSRF protection), functional (for preferences such as saved searches), and first-party analytics(anonymous session identifiers we generate to measure page views, searches, realtor profile views, and lead submissions). You can disable cookies through your browser settings; some features may not work without them.
7. Email communications
We send transactional emails related to your account, lead activity, and billing. We send marketing or newsletter emails only with your consent. Every marketing email includes an unsubscribe link, and we honor unsubscribe requests promptly. Transactional emails are sent for as long as you have an active account.
8. Data retention
We retain personal information for as long as needed to provide the Services, comply with legal obligations (including tax and real-estate record requirements), resolve disputes, and enforce our agreements. Typical retention periods:
- Account data: while your account is active and up to 24 months after closure.
- Leads and contact messages: up to 36 months from submission.
- Billing records: at least 7 years to meet tax and accounting obligations.
- Analytics data: up to 26 months, then aggregated.
9. Security
We use industry-standard technical and organizational measures including encryption in transit (HTTPS/TLS), encryption at rest, role-based access controls, row-level security on our database, audit logging, and least-privilege service credentials. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
10. Your rights
Depending on where you live, you may have the right to:
- Access, correct, or delete personal information we hold about you.
- Request a portable copy of your information.
- Opt out of marketing communications.
- Withdraw consent where processing is based on consent.
- Lodge a complaint with a supervisory authority.
Florida residents: the Florida Digital Bill of Rights (effective July 1, 2024) provides certain rights to qualifying consumers, including the right to know, correct, delete, and opt out of the sale or sharing of personal information and targeted advertising. NestWiseIQ does not sell personal information and does not engage in targeted advertising as defined by Florida law.
California residents: the California Consumer Privacy Act (as amended by the CPRA) provides similar rights. We do not sell or share personal information for cross-context behavioral advertising.
To exercise any right, email us at privacy@nestwiseiq.com. We will verify your identity before responding and reply within the timeframes required by applicable law.
11. Children
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.
12. International users
NestWiseIQ is operated from the United States. If you access the Services from outside the U.S., you understand that your information will be transferred to and processed in the United States, which may have data-protection laws different from those of your jurisdiction.
13. Third-party services and links
The Services may link to third-party websites, including brokerage websites, MLS feeds, school-rating providers, municipal sites, and social platforms. We are not responsible for the privacy practices of those sites. Review their policies before providing personal information.
14. Real-estate disclaimer
Community information, scores, and listings on NestWiseIQ are provided for informational purposes only. NestWiseIQ is not a real-estate broker. Realtors listed in our directory are independent professionals. Confirm material facts (HOA rules, school attendance, taxes, zoning, square footage) directly with the listing brokerage, HOA, school district, and municipality before making a real-estate decision.
15. Changes to this Policy
We may update this Privacy Policy from time to time. When we do, we will update the Effective Date above and, for material changes, provide additional notice (such as an in-product banner or email).
