Terms of Service

Effective date: May 30, 2026

1. Agreement

These Terms of Service (“Terms”) are a binding agreement between you and NestWiseIQ (“NestWiseIQ,” “we,” “us,” or “our”), based in Palm Beach County, Florida. By accessing or using nestwiseiq.com and any related services (the “Services”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and able to form a binding contract under applicable law to use the Services. By using the Services you represent that you meet these requirements.

3. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • Provide accurate information and keep it current.
  • You may sign in with email/password or with a supported identity provider such as Google. Their terms also apply to your use of those services.
  • Notify us immediately of any unauthorized use of your account.

4. Permitted use

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Reverse engineer, scrape, or systematically extract data from the Services except as expressly permitted.
  • Use the Services to violate any law, regulation, or third-party right (including fair-housing, anti-discrimination, telemarketing, and consumer-protection laws).
  • Upload content that is unlawful, infringing, defamatory, deceptive, harassing, or harmful.
  • Interfere with the security or integrity of the Services or attempt to gain unauthorized access.
  • Use the Services to send spam, unsolicited marketing, or unauthorized commercial communications.
  • Impersonate any person or misrepresent your affiliation with any person or organization.

5. Realtor directory and content

Realtors who apply to be listed represent and warrant that they hold an active Florida real-estate license (or other applicable license) and that all information they submit (including biography, photo, license number, brokerage, and contact information) is accurate, current, and lawful. NestWiseIQ may verify, edit, or remove any submitted content at its discretion. Realtors grant NestWiseIQ a non-exclusive, worldwide, royalty-free license to host, display, and distribute their submitted content as part of the Services.

6. Community information and scores

Community profiles, scores, school information, demographic data, and other community intelligence are provided for general informational purposes only. They are not appraisals, not real-estate advice, and not a substitute for independent professional judgment. We make no warranty as to the accuracy, completeness, or timeliness of community data, and we may change methodology at any time.

7. Leads and contact forms

When you submit a lead, inquiry, or contact-form message, you consent to NestWiseIQ routing your message to the appropriate realtor, partner, or our internal team for response, and to being contacted by them by email or phone at the contact details you provided. You are responsible for the accuracy of the contact information you submit.

8. Subscriptions and payments

  • Paid subscriptions (including the Founding Realtor, Premium, and Preferred tiers) are billed by Stripe at the prices and intervals shown at checkout.
  • Fees are charged in advance and are non-refundable except as required by law or as expressly stated at the point of sale.
  • You authorize us and Stripe to charge your selected payment method on a recurring basis until you cancel.
  • You may cancel at any time; cancellation takes effect at the end of the current billing period.
  • We may change fees on at least 30 days’ notice; changes take effect at your next renewal.

9. Intellectual property

NestWiseIQ and its licensors own the Services and all related software, content, trademarks, and logos, except for user- submitted content. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. All rights not expressly granted are reserved.

10. User-submitted content

You retain ownership of content you submit. By submitting content, you grant NestWiseIQ a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, display, reproduce, modify, and distribute that content in connection with operating and promoting the Services. You represent that you have all rights necessary to grant this license.

11. Third-party services

The Services rely on third-party providers (hosting, authentication, payment processing, email delivery, analytics, maps, and public data sources). Their terms and privacy practices apply to your use of those features. We are not responsible for third-party services.

12. Real-estate and fair-housing disclaimer

NestWiseIQ is not a real-estate brokerage, is not a party to any real-estate transaction, and does not provide legal, tax, financial, mortgage, insurance, or appraisal advice. Realtors listed in our directory are independent professionals, not employees or agents of NestWiseIQ. All advertising for housing on or through the Services is subject to the federal Fair Housing Act and applicable Florida fair-housing laws, which prohibit discrimination based on race, color, religion, sex (including gender, gender identity, sexual orientation, and pregnancy), handicap, familial status, or national origin. Confirm material facts directly with the listing brokerage, HOA, school district, and municipality before making any real-estate decision.

13. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, NESTWISEIQ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT COMMUNITY OR REALTOR DATA WILL BE COMPLETE, ACCURATE, OR CURRENT.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NESTWISEIQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID NESTWISEIQ IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow these limitations, so they may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless NestWiseIQ and its affiliates from any claim, liability, damage, loss, or expense (including reasonable attorneys’ fees) arising out of or relating to your use of the Services, your content, or your breach of these Terms or applicable law.

16. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, and dispute-resolution terms.

17. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. The exclusive venue for any dispute that is not subject to arbitration will be the state or federal courts located in Palm Beach County, Florida, and you consent to personal jurisdiction there.

18. Dispute resolution; class-action waiver

Except for small-claims actions and equitable relief, any dispute arising from these Terms or the Services will be resolved by binding individual arbitration administered in Palm Beach County, Florida, under the Federal Arbitration Act and the rules of the American Arbitration Association. You and NestWiseIQ each waive the right to a jury trial and the right to participate in any class or representative action.

19. Changes to these Terms

We may update these Terms from time to time. We will update the Effective Date above and, for material changes, provide additional notice. Your continued use of the Services after an update constitutes acceptance of the revised Terms.
